When a relationship breaks down, the future can often seem uncertain. That’s why it is paramount that you seek legal advice as early as possible to ensure you receive the best advice for you and your family’s future.

We are a member of the Law Society Family Law Advanced Panel.

We are a member of Resolution.  Resolution members are committed to a constructive and non-confrontational approach.

Colette Fletcher is a Collaborative trained Lawyer.  A collaborative approach to relationship breakdown is where you, your opponent and both lawyers meet together to try to work things out face to face and try to resolve the issues without going to court. They are committed to achieving the best results by agreement rather than through court proceedings, the process does however prevent the lawyers from representing you in court if the collaborative process breaks down.

We have considerable advocacy experience and can conduct your proceedings at Court.

Based in Mold, with excellent road links to nearby larger towns and city centres, we are able to offer clients the same skills and expertise at very competitive charging rates.   Our approved experts to include Barristers, Financial/Pension experts, translators, enquiry agents and health specialists are carefully selected from throughout the North West and North Wales based on quality of service and price.

There have been many changes to Legal Aid funding over recent years.  We remain committed to retaining a contract with the Legal Aid Agency for matters that remain in scope for public funding to include public law children  and domestic violence.

We also offer a Fixed Fee service for family advice.

With experience in dealing with the complex needs of clients, we are able to offer assistance in the following areas of family law:

Divorce and Separation

Divorce is not often straightforward. Matters can become complicated where there is a disagreement over assets, financial settlements, and arrangements for children. This can create added strain during an already distressing period, especially when there are children involved.

Where matters are agreed upon separation and a divorce appears to be a straightforward process, it is still important that you seek advice to ensure that the agreed split of assets/finances is recorded to avoid any complications arising in the future (this is known as a “Clean Break”).

As experienced family law specialists, the solicitors at Llewellyn-Jones can manage the whole legal process, protect your interests and deal with the process as quickly and smoothly as possible.

We also have experience in dealing with:

  • Marriages conducted abroad
  • Clients living abroad

We offer a Fixed Fee service for initial interview which serves as a starting point on your current position, the options available and general advice and assistance.

Our family solicitors are members of Resolution and committed to adopting a non-confrontational approach to resolving family issues.

Cohabitation Disputes

Sometimes couples choose to live together in long-term relationships without marrying, and this can often result in complications when disputes arise. This is because contrary to popular belief there is no such thing as a ‘common-law’ husband or wife, meaning in the event of a separation the rights afforded are completely different.

For couples who have no intention of marrying, it is advisable that a Cohabitation Agreement is signed early on in the relationship. This legal document outlines an agreement between both parties, addressing a whole spectrum of potential issues, including: mortgage payments, content ownership, outgoings and more.

In the absence of a cohabitation agreement and in the event of a dispute between cohabiting couples, legal assistance can be provided by the specialists at Llewellyn-Jones. This includes advising on:

  • Family home and other assets
  • Parental matters
  • Financial settlements
  • Inheritance

Pre-Nuptial Agreements

With all assets becoming matrimonial assets once married, many couples are now signing pre-nuptial agreements as a way to legally record what is owned by each partner. By doing this, each party’s interests can be secured for the future, making separation an easier and more transparent process should the relationship breakdown . This can prevent disputes in the long term and can relieve some of the stress involved, especially where children are concerned.

Care Proceedings

The words “care proceedings” cover many aspects of children issues.  This can include

  • A child being included on the Child Protection Register
  • Involvement in Child protection conferences possibly resulting in the issue of a Child protection plan
  • Interim or full care orders,
  • Emergency Protection Orders (EPO) – Section 44 Children Act 1989
  • Care Orders – section 31 Children Act 1989
  • Supervision Orders – section 31 Children Act 1989
  • Secure Accommodation Orders – section 25 Children Act 1989
  • Contact / Indirect contact orders made for a parent, a grandparent or a sibling or other relative for a child in care

There are many causes for involvement in care proceedings to include concerns that have been raised about neglect, physical, sexual or emotional abuse.

Many organisations /individuals can be involved in Care proceedings, such as

  • Police, health agencies, doctors, health visitors, schools and other agencies
  • Local Authority – Children’s Services
  • Cafcass ( Children and Family Court Advisory and Support Service.) – who represent children in family court cases.  A Cafcass worker, when working on care cases, is known as a ‘children’s guardian.  The guardian will appoint a solicitor to represent the child.

We hold a Legal Aid public law contract meaning that we can assist immediately when a letter before proceedings has been issued to you as a parent.  You will automatically be eligible for public funding.    At Llewellyn-Jones we have been awarded membership of the Law Society Family Law Advanced Panel (Adult Parties representative).

If you become a party to care proceedings it is essential that you seek advice from one of our experienced solicitors at Llewellyn-Jones
